Abstract:
In March 1998, after two years of negotiations, 95 governments finalized the text of the Convention on the Prior Informed Consent (PIC) Procedure for Certain Hazardous Chemicals and Pesticides in International Trade. The text of the convention was adopted and opened for signature at the Conference of Plenipotentiaries in Rotterdam 10-11 September 1998. The Convention represents an important step towards ensuring the protection of citizens and the environment in all countries from the possible dangers resulting from trade in highly dangerous pesticides and chemicals. It will save lives and protect the environment from the adverse effects of toxic pesticides and other chemicals. It will establish a first line of defense against future tragedies by preventing unwanted imports of dangerous chemicals, particularly in developing countries, and extend to all countries the ability to protect themselves against the risks of toxic substances. In short, the Convention will enable the world to monitor and control the trade in very dangerous substances. It will give importing countries the power to decide which chemicals they want to receive and to exclude those they cannot manage safely. If trade does take place, requirements for labelling and provision of information on potential health and environmental effects will promote the safe use of these chemicals. The PIC procedure helps participating countries learn more about the characteristics of potentially hazardous chemicals that may be shipped to them, initiates a decision-making process on the future import of these chemicals by the countries themselves and facilitates the dissemination of this decision to other countries. The objective of the PIC procedure is to provide countries with detailed information on specific pesticides and chemicals, as well as reasons for bans or severe restrictions placed upon them. This information can be found in the form of Decision Guidance Documents (DGDs). In light of this information, countries are asked to assess their position and the risks associated with the chemical or pesticide in question, and to make timely and informed decisions as to its importation and use. A compilation of these import decisions together with a PIC Circular is transmitted to all participating countries every six months.
